草案的形成？

  • 相關草案形成主要由部會提案時提供，部會有時委託專家學者撰寫，如：

（1）企業資產擔保法（草案）：謝在全大法官

（2）網路賣酒：財政部賦稅署

  • 部會委託科法

（一）草案文字提供

（1）零售業等網路交易定型化契約應記載及不得記載事項第五點（確認機制）

（2）公司法閉鎖性公司專章（與邵慶平教授合作）

（3）公司法系列修法（社企，英文名稱登記，董監選任）：經濟部

（二）科法在vtaiwan平臺上主要任務為提供國際法制趨勢和意見，提供部會和網友參考; 以及基於幕僚單位，提供政策建議：

（1）共享經濟（uber/airbnb）國際法制

（2）群募募資相關法規意見

（3）網路交易課稅

  • 透過網友協作完成：透過vtaiwan意見徵集過程，部會採用網友建議而成，如：群眾募資有關募資金額之門檻。

 

是 co-create, 隨時都有各方的 (民間，學者，政府)，目前的案例政府都有在送交立院前負責做 final draft. vTaiwan 也並沒有規定一定要政府做，只是目前還沒有民間直接做草案的案例。

  • AUDREY T2014-06
    • "Virtual World Law Adjustment Program" kickoff meeting, headed by Minister without portfolio Jaclyn Tsai, with assistance from National Development Council's Regulatory Reform Center.
  • 2014-07
    • Jaclyn Tsai invited each ministry to propose at least one cyberspace-related case for public consultation.
  • 2014-12
    • SHU LJaclyn Tsai participated in g0v hackthon and proposed to co-create a consensus-based online policy making mechanism with the civil society.
  • AUDREY T2015-02
    • SHU LvTaiwan.tw launched with two topics: Closely-held corporations and equity-based crowdfunding.

    • First livestreamed public consultation meeting with forum participants as attendees.
    • First livestreamed working group meeting to co-create drafts of regulations and laws.
    • Second batch of topics posted online, such as "Classification of Government Data and Licensing Principles", MOOCs, Telework, Privacy and De-identification, etc.
  • 2015-04
    • "Equity-based Crowdfunding" regulation ratified by the financial supervisory commission.
  • 2015-05
    • Company Law Act amendment passed administration review and sent to the parliament.

    • Members of parliament signs Company Law Act amendment into law.

    • UberX's case enters online discussion phase on vTaiwan, the first case to use Pol.is for stakeholder discovery.

    • "Classification of Government Data and Licensing Principles" ratified by the national development council, with the national open data license co-written with the civil society.
  • 2016-03
    • Digital Convergence Laws begins consultation on vTaiwan, including the Telecommunication Act designed as the bridge to internet governance.

    • First livestreamed public consultation in VR360.
  • 2016-05
    • Digital Convergence Laws passed administration review.
  • 2016-08
    • FinTech sandbox and Company Law Act rewrite (foreign names) enters online discussion phase on vTaiwan, the first cases to use Sli.do for stakeholder discovery.
  • SHU L2016-10
    • Audrey Tang, one of the key contributors of vTaiwan, becomes the Digital Minister.
  • AUDREY T2016-12
    • Revised Telecommunication Act draft begins request for public commentary; this version includes vTaiwan-like multi-stakeholder mechanism as part of administrative functions.

    • AUDREY TNineteen topics has been discussed through vTaiwan, where 16 of them contributes to decisive government action.
